Migration of a company is a project with a very diverse set of matters to be managed, which impacts the legal structure, the tax structure and the social structure of the company at hand. It is our approach to run through every stage of the process with the project leaders, and where so desired the employees involved, to ensure predictability in every step, both regards tax matters at hand for the company itself and the foreign employees concerned or Dutch employees engaged in the process. Legal processes are frequently not keeping up with commercial pace. We therefore recommend to involve local counsel as early in the migration or establishment stage as possible to ensure alignment of both and proactively manage where hiccups may arise.
